Terms of Service — Foobud

Version in force: 10 October 2026

1. Purpose

These Terms of Service ("Terms") govern the use of the Foobud mobile application (hereinafter "the App"), published by Sébastien CAILLAUD, natural person, reachable at contact@foobud.com (hereinafter "the Publisher").

The foobud.com website and associated online services are hosted by Google LLC (Firebase Hosting service), 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

By downloading, installing, or using the App, you ("the User") accept these Terms without reservation.

2. Service Description

Foobud is an application for managing food intolerances and dietary restrictions. It enables the User to:

3. Access to the Service

3.1 Free Version

The App is accessible free of charge without registration or account creation. All data is stored locally on the User's device.

Free limitations:

3.2 Premium Version

Access to Premium features requires a paid subscription through application stores (Apple App Store or Google Play Store).

Premium features:

4. Premium Subscription

4.1 Pricing

The Premium subscription is offered on a monthly or yearly basis. The current price is displayed in the App and on the Google Play Store (or Apple App Store) listing before any purchase, in your local currency and inclusive of all taxes.

Prices may change; the applicable price is always the one shown at the time of purchase. Any change to the price of an active subscription will be notified to you as provided by the relevant application store.

4.2 Automatic Renewal

Subscription automatically renews unless cancelled at least 24 hours before the end of the current period.

Renewal is charged at the current rate. You can manage your subscription and disable auto-renewal at any time from your App Store or Play Store account settings.

4.3 Cancellation and Refund

Cancellation takes effect at the end of the current subscription period. No pro-rata refund is issued for the unused period.

Any refunds are managed directly by Apple or Google according to their respective terms. These provisions are without prejudice to the right of withdrawal described in section 4.5.

4.4 Post-Downgrade Grace Period

If your Premium subscription ends, your cloud data is retained for 30 days to allow you to renew your subscription without loss. After this period, your cloud data is permanently deleted (your local data on the device is not affected).

4.5 Right of Withdrawal

Under Article L221-18 of the French Consumer Code (and Directive 2011/83/EU for European consumers), consumers in principle have a 14-day withdrawal period from the date of subscription.

By subscribing to Premium, you expressly request its immediate performance — access to Premium features is activated instantly — and expressly waive your right of withdrawal once performance has begun, in accordance with Article L221-28 of the French Consumer Code.

Any refund request must be made directly to the application store that processed the transaction (Google Play or App Store), under its own terms.

4.6 Free Trial (App Store)

On the Apple App Store, new subscribers may be offered a 7-day free trial, as shown in the App and on the App Store before subscribing. Eligibility is determined by Apple (in principle one trial per Apple account).

At the end of the trial, the subscription automatically becomes paid and then renews under the conditions of section 4.2, unless cancelled at least 24 hours before the end of the trial. Cancelling during the trial costs nothing; Premium access then ends at the end of the trial.

Any unused portion of a free trial is forfeited when you purchase a subscription.

5. Authentication

Authentication is required to subscribe to Premium and to reconnect to an existing Premium account. It is carried out, at your choice, via Sign in with Google, Sign in with Apple (on iPhone), or an email address and a password. No authentication is required for the Free version.

The User undertakes to provide accurate information and to protect device access. The Publisher cannot be held liable for unauthorized access resulting from User negligence.

6. Intellectual Property

The App, its source code, design, brand, and all elements composing it are the exclusive property of the Publisher and are protected by applicable intellectual property laws.

Data entered by the User (contacts, meals, restrictions) remains the exclusive property of the User.

7. Liability

7.1 Non-Medical Information

Foobud does not provide medical advice. The App is a personal tool for organizing and managing dietary information. Information regarding allergies, intolerances, or diets is provided for informational purposes only and shall not substitute for the advice of a healthcare professional.

The App merely records and displays information entered by the User or shared by other users, without any verification of its accuracy, completeness, or currency. The User who prepares or serves a meal remains solely responsible for verifying allergies and dietary restrictions directly with the persons concerned, as well as the actual composition of the food served; the App in no way replaces this verification.

Consequently, an allergic reaction or health issue can only result from factors entirely beyond the Publisher's control — information entered, shared, outdated, or unverified by users, or the actual composition of the food. The Publisher, bound by a best-efforts obligation, cannot be held liable for such events, except in the event of proven fault on its part and only for the direct damages arising therefrom.

7.2 Data Loss

Free Users' attention is expressly drawn to the fact that all their data is stored locally on their device. In case of loss, theft, breakage, reset, or uninstallation of the app, all data will be permanently lost with no possibility of recovery.

The Premium subscription is the only cloud backup option offered by the App.

7.3 Service Availability

The Publisher strives to ensure optimal service availability but cannot guarantee 100% availability. Interruptions may occur for maintenance, updates, or reasons beyond the Publisher's control.

8. User Conduct

The User undertakes to:

9. Account and Data Deletion

The User may at any time:

See the Privacy Policy for details of deleted data and associated timelines.

10. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall be subject to the competent French courts, unless mandatory provisions provide otherwise.

For European consumers outside France, the mandatory provisions of the law of the country of residence apply.

11. Changes to the Terms

The Publisher reserves the right to modify these Terms at any time. Substantial modifications will be notified via the App. Continued use after modification constitutes acceptance of the new Terms. If you refuse the modified Terms, you may stop using the App and, where applicable, cancel your Premium subscription; cancellation takes effect at the end of the current subscription period.

12. Apple App Store

If you obtained the App from the Apple App Store, the following provisions also apply:
